1. ARTWORK AND RENDERS

1.1 - All artwork is based purely on the 2D architectural plans supplied to us - that means that anything not featured on those drawings will not be included, as there would not be a direct reference for us to build from.

1.2 - We offer our clients the use of 'generic furniture' should they wish to include it in their model - this means a small selection of everyday items in a pre defined asset database such as toilets, showers, sofas, dining room table/chairs, doors, window frames, basic kitchens, beds and the like. We are unable to model specific furniture for your 3D model at this time (apart from kitchens, which is additionally charged), and this is not included in the price of the build. Please see relevant package for additional costs of adding generic furniture, with no hidden fees. Furniture will be scaled to that included in the original architects drawings.

1.3 - The process will be delivered in 3 stages - 1.) The untextured model (where the building will be presented as a white 'clay' model) - all changes need to be made to the model before the next stage. 2.) The textured model - once the previous iteration has been approved, we will add textures such as brickwork, roofing, wooden flooring etc. Any changes to the structure of the building after texturing has been implemented will be charged at £95 + VAT per hour. 3.) The interactive build - the textured model will be ported to our real time gaming engine, to add lighting and to make use of the 'walkthrough' element, where we can showcase different angles of the interior/exterior, and create a sequence of JPGs (price per package), or an animated video (price per package).

1.4 - Once approval has been made on the design proofs we send to you, we will digitally send over JPGs of the model from different angles (number determined by purchased package) to showcase the interior and exterior.

1.5 - We can also create interactive walkthroughs of the model, for an additional fee (price determined on application). The 3D model will need to be fully approved before we can port the model into the gaming engine. Any changes to the build made after the model has been ported to the game engine will be charged at £95+VAT per hour.

1.6 - We can create a short 2 minute video of the final model, incorporating different camera angles, set to copyright free classical music. This will be a short showcase of the interior and exterior of the property. This is purchased as an additional add-on at £2499 + VAT. You are permitted one round of revisions to the video, but any additional changes will be charged at £95 + VAT per hour.

2. LIABILITY

2.1 - We can accept no responsibility for loss or damage caused by using the 3D renders we have created for anything other than for illustrative purposes - this includes for use in construction or measurement sensitive uses. We render an artists' impression of your property and as such this should only be used as a visualisation tool.

2.2 - We are not liable for any financial loss incurred by you, including but not limited to expenses incurred by you, interest payments & loss of earnings or similar gains you would have received if the 3D model is used for anything other than illustrative purposes/an artists impression.

3. INDEMINITY

3.1 - All SimplyGraphics™ services may be used for lawful purposes only. The Client agrees to indemnify of SimplyGraphics™ of any damages, losses and expenses arising as a result of any and all actions or claims resulting from the Client’s use of SimplyGraphics™ service unlawfully or otherwise.

4. PAYMENT TERMS

4.1 ACCOUNT

Payment shall be made in full within 30 days following the date at which the invoice is raised, unless special settlement terms have been agreed by us in writing.

4.2 NON ACCOUNT

Payment is due 50% upfront and 50% upon completion/just before delivery.

4.3 DISCOUNT

Any discounts are offered on the strict understanding that accounts are paid by the due date. We reserve the right to invoice any such discounts to accounts which become overdue.

4.4 VAT

VAT is payable on all orders and is charged at the current rate of 20%.

5. OVERDUE ACCOUNTS

5.1 - No goods will be delivered on accounts which remain unpaid 14 days after payment is due. We reserve the right to charge interest on overdue accounts, at the rate of 5% above the Barclays Bank Plc base rate from time to time from the date the account became due until payment is received. This does not prevent us from pursuing payment of overdue accounts at any time after payment becomes due and shall be in addition to and without prejudice to any other rights we may have against you.

5.2 - We reserve the right to charge you for any legal charges where it is necessary to obtain payment from you of an overdue account through a third party or Court proceedings.

6. PASSING OF TITLE

6.1 - All goods, delivered or not, remain our property until payment is received in full.

7. PRODUCTS

7.1 - We reserve the right to alter any details of services/offers advertised without notice and while every effort is made to describe services accurately in the advertisement, no warranty is given as to accuracy and no responsibility will be accepted for error and any resulting loss.

8. QUOTATIONS 

8.1 - Orders are accepted subject to our right to adjust prices quoted to take account of any changes in the law or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties or otherwise.

8.2 - Quotations are only valid for 28 days after the initial quote date.

8.3 - Any price or quotation is subject to change at any point without notice, including advertised offers.

9. PRICES

9.1 - Where applicable all prices quoted are subject to VAT at the current rate.

10. DELIVERY

10.1 - Every effort will be made to deliver on time, but any delivery day specified is at best an estimate and no liability is accepted for any loss arising from delay or error in the delivery of the service.

11. REFUNDS

11.1 - As our work is purely design based, refunds will only be offered minus the time spent working on the project so far. If the client pulls out of the project due to a change in plan their side, this will not be reflected on the amount of time it has taken for us to create the design and thus will still be chargeable. All 50% deposits are non refundable.

12. - CANCELLATION CHARGES 

12.1 - Any costs incurred for work already carried out up to the date of written cancellation will also be charged for and deducted before any refunds are made. If the order has not yet been paid for, then an invoice will be raised for the amount concerned and sent to the responsible party.

13. DESIGN CREDIT & MARKETING

13.1 - The Simply ArchViz brand will appear at the bottom of the build when finished. If a client requests that the design credit be removed, a nominal fee of 10% of the total development charges will be applied.

13.2 - The Client agrees that the 3D Model developed for the Client may be presented in the Simply ArchViz portfolio, and hereby grants Simply ArchViz a worldwide, perpetual, non-exclusive licence to use its name, logo and branding for advertising, marketing and promotional activities. Requests to ensure we do not share this work in our portfolio will be charged at £799 + VAT.
